INSOLVENT PUBLIC MOTOR VEHICLE FUND
TO PAY $18 MILLION TO CREDITORS, EASING
COURT BACKLOG
Long-suffering accident victims will soon receive payment of their
claims from the insolvent New York Public Motor Vehicle Security
Fund (PMV) thanks to an $18 million one‑time infusion to the PMV
fund produced by the determined efforts of the New York Liquidation
Bureau. The cash
infusion will not only permit the long-delayed payouts but will also
speed up the processing of current PMV claims, reducing the large
backlog of cases that has bedeviled the court system for years.
“Funding $18
million into the PMV fund will allow the New York Liquidation Bureau
to begin paying claimants and processing PMV claims, two activities
that have been at a virtual stand-still since the fund became
insolvent. The people
who have been waiting for payment have been injured twice -- once at
the time of the accident involving a vehicle covered by the PMV
fund, and again when they were unable to promptly collect the money
awarded to them by the court,” said Mark G. Peters, Special Deputy
Superintendent in Charge of the Bureau.
"Whenever cases languish in the
courts, the public is not well served. We are pleased that these
cases, some of which have been pending for more than a year, will be
resolved and the claimants can access the funds that are due to
them. We appreciate the efforts of the Bureau to provide the
resources to make this possible,” said Judge Ann Pfau, New York
State Chief Administrative Judge.
"This action removes a long-standing obstacle to the resolution of
many outstanding claims made on behalf of individuals who have
waited far too long for justice and just compensation for their
injuries," said Assemblyman Joseph D. Morelle, who chairs the
Assembly’s
Standing Committee on Insurance.
"I commend the Liquidation Bureau for its diligence and commitment
in this matter."
The PMV Fund acts as a secondary
insurer for New York
public vehicles, such as taxis, buses and ambulances, where the
primary insurer is insolvent.
The PMV Fund is financed by annual contributions from solvent
New York
carriers that insure public vehicles, but those contributions have
been insufficient to pay either the PMV claims as they become due or
the expenses to process those claims.
As a result, claimants must typically wait eighteen months
for payment of their court-approved claims.
Also, because there is no money to process cases, even cases
that have been settled in principle by all parties, a large number
of PMV cases remain unresolved in the courts due to lack of funds.
Upon taking office in April 2007, the
Bureau’s new management immediately implemented an intensive reform
and housecleaning effort.
The PMV insolvency was identified as a priority and potential
solutions were investigated.
The NYLB determined that the PMV Fund was entitled to receive
from the New York Merchant Bakers Insurance Company an $18 million
infusion as an early access distribution.
“We are pleased that we have been
able to identify and implement this temporary solution to the
chronic PMV under-funding issue,” Mr. Peters said.
“While our plan will help claimants and the courts in the
near term, the $18 million will be fully disbursed in the next year
or two to pay court-ordered claims and to process pending claims.
After that, the PMV will again not have enough assets and
delays will build again.
That’s why a long-term solution is still needed to ensure that
claims are promptly processed and paid in the future.”
The New York Liquidation Bureau is a
non-governmental entity, independent of the New York State Insurance
Department, which carries out the responsibilities of the New York
State Superintendent of Insurance in his role as receiver, and acts
on his behalf to discharge his statutory duties to protect the
interests of policyholders and creditors of insurance companies that
have been declared impaired or insolvent.

Compeer Rochester has just received federal funding
to continue its Mentoring Children of Promise Program for another
three years. This program gives community volunteers the opportunity
to mentor youth ages 4 to 17 who have one or two incarcerated
parents. Mentors spend four hours a month with youth doing fun
activities they both enjoy. Interested volunteers and families with

A plane crash is an uncontrolled landing. The pilot and his/her
team manage and mitigate the risk to the extent that each and every
time the plane lands safely and without incident. Using that
philosophy this presentation will look at project risk management.
Project risk management is defined as the processes concerned with
identifying, analyzing and responding to project risk. A risk is any
future event or condition that could prevent the project from
achieving its objectives. To achieve maximum benefit, it must be
viewed as an ongoing activity whose major components have multiple
iterations during the execution of the project. Risk management is
made up of six major risk related processes namely Risk Management
Planning, Risk Identification, Qualitative Risk Analysis,
Quantitative Risk Analysis, Risk Response Planning and Risk
Monitoring and Control. We will, in the presentation look at each
component and identify deliverables, tools and techniques to
mitigate and manage these risks effectively to ensure project
success.
Bio:
Ashok Gupta joined Shell as Global Senior Project Manager in July
2000. He has over 20 years' experience in Information Technology,
project management and finance, predominantly in the Publishing,
Pharmaceutical and Energy sectors. Prior to Shell, Ashok spent six
years with Glaxo Smith Kline as an IT manager and seven years with
Tribune Company, initially as Systems analyst and then as IT
manager. During his tenure at Shell, Ashok has been involved as
Program Manager for multi million global projects in Financial Off
shoring, Oil exploration and Retail. He is currently managing an
asset integrity project for pipelines and tanks for Shell
Distribution. He has an MBA, a Masters in Computer Science, and a
certification in Project Management (PMP) and in Change Management
(CMP) from the Wharton School. Ashok is married, with one daughter.
He was educated in India and US and now lives in Rochester, NY, US.

Project URGE invites the community to learn more about
Rochester’s committed service organizations
and ministries, by meeting some of the organizations and hitching a
ride directly to the action.
On Saturday morning, November 3rd, beginning at Browncroft Community Church
at 9am to 12:30pm, participants will get a chance to hear
presentations and meet with those who serve the under-resourced,
abused, and at-risk youth. Pre-registration is required and seating
is limited!
This is the fifth year participants will hear from and visit a
broad spectrum of organizations, which include: after-school
programs and summer camps for at-risk youth, soup kitchens, clothing
ministries, entrepreneurial education, drug and alcohol rehab, food
pantries, health/wellness and more. Foodlink, Rochester Teen
Challenge, Community Lutheran Ministry, Rochester Recovery House,
Project URGE, Sanctuary House and Grace
Community
Village are just a
sampling of some of the organizations that will be represented.
This URGEnt event will help inform those who may be searching for
opportunities to serve. Participants will choose an area where they
will visit 5-6 sites and they’ll have an opportunity to meet with
approximately 20 organizations prior to the tour. A continental
breakfast will be offered with juice and coffee.
The trip will provide an in-depth view of the good work being
done daily, as well as expose some of the profound needs in the Rochester community. Come
discover specific ways and places to mend the brokenness in our
city.
